When creating an account, you agree to provide information that is accurate, complete, and current at all times. Failure to do so constitutes a breach of the Terms, which may result in immediate suspension or termination of your account.

You are entirely responsible for safeguarding your password and for any activities or actions under your account. You must notify us immediately if you suspect unauthorised use of your account or any other security breach. We will not be liable for any loss or damage arising from your failure to protect your login credentials.

3. Acceptable Use Policy (AUP)

Aka.my URL Shortener is designed to share links easily. By using our Service, you agree that you will not create short URLs that redirect to, or otherwise associate our Service with, any of the following:

  • Malicious Content: Malware, viruses, trojans, ransomware, or any other destructive code.
  • Phishing and Scams: Sites designed to steal passwords, financial data, or personally identifiable information.
  • Illegal Material: Content that violates any applicable local, national, or international laws, including the distribution of Child Sexual Abuse Material (CSAM).
  • Intellectual Property Infringement: Content that infringes upon the copyrights, trademarks, or patents of others.
  • Hate Speech and Harassment: Content that promotes violence, incites hatred, discriminates against protected groups, or involves doxxing or targeted harassment.
  • Spam and Botting: Bulk unsolicited messaging, link farming, or automated link creation without our explicit prior permission.

We reserve the right to review, block, or permanently delete any URLs and suspend associated accounts that violate this policy, without prior notice or liability.

4. API Usage

If you access our Service via an Application Programming Interface (API), you must use it in a reasonable manner. We reserve the right to enforce rate limits on API requests to prevent server overload and ensure fair usage for all users.

You may not use our API to circumvent our Acceptable Use Policy, commercialise our core services without a written agreement, or knowingly crash or disrupt our servers. We may revoke your API access at any time, for any reason, at our sole discretion.

5. Right to Reclaim or Disable URLs

We do not guarantee the permanent availability of any specific short URL. We reserve the right to reclaim, reassign, or disable short URLs at our sole discretion. This includes, but is not limited to, situations involving:

  • Trademark disputes where a brand claims ownership of a specific custom alias.
  • URLs that have remained completely inactive (zero clicks) for an extended period of time (e.g., 24 months).
  • URLs that violate our Acceptable Use Policy.

6. Copyright and Takedown Policy

We respect the intellectual property rights of others. If you believe a shortened link created through our Service redirects to content that infringes on your copyright or trademark, please contact us with a formal takedown request containing:

  • Identification of the copyrighted work claimed to have been infringed.
  • The specific Aka.my URL that is facilitating the infringement.
  • Your contact information (name, email, and physical address).
  • A statement of good faith belief that the use is unauthorised.

Upon receipt of a valid notice, we will investigate and disable the offending link as necessary.

7. Paid Upgrades and Refunds

The core features of Aka.my URL Shortener are free. However, optional paid upgrades (monthly, annual, or lifetime) are available to unlock premium features and support our infrastructure. Payments are processed securely via Stripe. We do not store your payment card details.

We offer a 7-day Money-Back Guarantee for paid upgrades. To prevent abuse, refunds are strictly limited to one per user. To request a refund within 7 days of purchase, please contact us.

8. Lifetime Plan Disclaimer

The term “lifetime” in any upgrade or plan refers specifically to the lifetime of the Service itself, not the lifetime of any individual user. We reserve the right to discontinue or modify any “lifetime” plan or feature at our sole discretion, including if the Service is no longer maintained or supported. We make no guarantees of perpetual availability.

9. Indemnification

You agree to defend, indemnify, and hold harmless Aka.my URL Shortener, its operators, directors, and employees from and against any and all claims, damages, obligations, losses, liabilities, costs, or debt, and expenses (including but not limited to legal fees) arising from:

  • Your use of and access to the Service.
  • Your violation of any term of these Terms and Conditions.
  • Your violation of any third-party right, including any copyright, trademark, privacy, or property right.

This defence and indemnification obligation will survive the termination of these Terms and your use of the Service.

10. Disclaimer of Warranties

The Service is provided on an "AS IS" and "AS AVAILABLE" basis. Aka.my URL Shortener makes no representations or warranties of any kind, express or implied, regarding the operation of the Service, the accuracy of the redirects, or the reliability of uptime. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by applicable law, in no event shall Aka.my URL Shortener be liable for any indirect, incidental, special, consequential, or punitive damages—including without limitation, loss of profits, data, use, goodwill, or other intangible losses—resulting from your access to or use of, or inability to access or use, the Service, even if we have been advised of the possibility of such damages.

12. Links to Third-Party Websites

Our Service redirects users to third-party websites that are not owned or controlled by us. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or services. You acknowledge that you click on shortened links at your own risk.

13. Termination

We may terminate or suspend your account and bar access to the Service immediately, without prior notice or liability, for any reason whatsoever, including without limitation a breach of the Terms. Upon termination, your right to use the Service will immediately cease.

14. Governing Law

These Terms shall be governed by and construed in accordance with the laws of Malaysia, without regard to its conflict of law provisions. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions will remain in full force and effect.

15. Changes to Terms

We reserve the right to update or modify these Terms at any time. If a revision is material, we will endeavour to provide at least 30 days' notice prior to any new terms taking effect. By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised Terms.
